Agreement to Terms

By accessing or using the services provided by TheFuture3D ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our services.

Services Description

TheFuture3D provides professional 3D scanning, virtual tour creation, drone services, scan-to-BIM modeling, and related digital documentation services. The specific services, deliverables, and timelines are defined in individual project proposals and agreements.

Client Responsibilities

As a client, you agree to:

• Provide accurate information about your project requirements
• Ensure safe and legal access to properties or sites to be scanned
• Obtain necessary permissions for scanning from property owners or managers
• Pay for services according to agreed terms
• Provide timely feedback and approvals when required

Payment Terms

Payment terms are specified in each project proposal. Standard terms include:

• 50% deposit required to schedule project
• Balance due upon delivery of final deliverables
• Late payments subject to 1.5% monthly interest
• We accept credit cards, ACH, and checks

Intellectual Property

Upon full payment, clients receive full ownership of all project deliverables including scan data, virtual tours, and BIM models. TheFuture3D retains a non-exclusive license to use deliverables for portfolio and marketing purposes unless otherwise agreed in writing.

Cancellation Policy

Cancellation terms:

• Cancellation 48+ hours before scheduled scan: Full refund of deposit
• Cancellation within 48 hours: 50% of deposit retained
• No-show or same-day cancellation: Full deposit retained
• Cancellation after work begins: Payment for completed work required

Warranty and Liability

TheFuture3D warrants that:

• Services will be performed in a professional manner
• Deliverables will meet specified accuracy requirements
• We will correct any errors in deliverables at no additional cost

Our liability is limited to the total amount paid for the specific project. We are not liable for consequential, incidental, or punitive damages.

Insurance

TheFuture3D maintains comprehensive general liability insurance, professional liability (errors and omissions) insurance, and drone liability insurance. Certificates of insurance are available upon request.

Confidentiality

We treat all client information and project data as confidential. We will not share, sell, or disclose project details to third parties without your consent, except as required by law. NDA agreements are available for sensitive projects.

Force Majeure

Neither party shall be liable for delays caused by circumstances beyond reasonable control, including natural disasters, government actions, labor disputes, or equipment failures. In such cases, project timelines will be adjusted accordingly.

Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Miami, Florida, under the rules of the American Arbitration Association.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these terms at any time. Changes become effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
